Michigan Gun Laws and state parks
Hey everybody.... Hopefully this is in the right place. I apologize if not...
So, I have an XD .40 service. I have my CCW in Michigan. had some questions on carrying, particularly in state parks/state land. wondering if anybody had any experience/clarification. So, here is the Michigan.gov official website. Look at #10, which i believes allows CCW in state parks: (btw, DNR= Dept. of Natural Resources) http://www.mi.gov/msp/0,1607,7-123-1...0953--,00.html here's another link from the state Attorney General in regards to CCW on state land that is pretty much completely contradictory: http://www.ag.state.mi.us/opinion/da...0s/op10198.htm I remember reading somewhere that it's legal to carry CCW as long as it ISN'T hunting season... which is contradictory to the last link. Just looking for some clarification, if possible. I've asked a few local cops and they all say it comes down to whichever conservation officer you run into. Lastly, anybody know how federal/national parks work? Somebody asks during my NRA CCW course and the lawyer said to call the local ranger station. Thanks for your time! matt |

I know were you are coming from I am in Mi also what I do is carry In the car a copy of both also your Mi hunting rules and regs you can carry during hunting season according to that even during bow . THey way I look at it is that DNR will be the ones stopping you (checking for License) what ever go by there rules as far as I know it has not come up when it does all the differance's will have to be sorted out If your not doing anything illegal when you get stopped ect you should not have a problem .....

well, i had read that second decision several times but had neglected to read the footnotes. apparently the first link i posted (DNR can't make laws superseding CCW laws) trumped that judge's decision... so apparently you can carry in state parks.
although the judge's decision saying it was legal to carry so long as it was UNLOADED was ridiculous. what's the good of having CCW if you it's unloaded? anybody know what the deal is with federal parks/lands? thanks! matt |

i'm in clinton county... spend a lot of time in ingham county.
I'm currently trying to figure out the Michigan State University CC rules... the MSU website has a "regulation" passed by the trustees saying it's illegal to possess a firearm anywhere on university property whereas Michigan law states illegal to carry only in dormitory or university classroom. i don't want to carry at school so much as keep in my car or drive through campus. i've got a call into an attorney at this point. thanks! |

If you're looking for a gun-smart attorney in MI, there's a guy named Jim Simmons who seems to be popular on the local MI boards. PM me if you want his info... I can pull it from a MI forum I'm a member of.
As far as university carry goes... i'll give you my halfassed understanding of it. Basically, the state constitution gives MSU and UoM (maybe other schools?) its own ordinance powers where it can pass university ordinances that have force of law. And because of the way they get their power, apparently the preemption clause does not apply. From what I've read on the subject, carrying on MSU or UoM campus anywhere is illegal. It sucks and shouldn't be this way, but I'm pretty sure that's what I've read. If you do talk to an attorney, please shed some light for us. |
