I gotta agree, from when my daughter was born until she burned herself on the woodstove, she was never out of sight when about more than 10 seconds. If she was about and crawling, we kept track of her. We weren't overbearing, just aware and we figured aware was just part of parenting.
Now about the woodstove: usually the heat is self limiting, so we did not worry about it. At the point where she decides to break thru her natural revulsion and come in contact with it, well that just reinforced her natural revulsion and no permanent damage done. Sort of from then on, she learned that our warnings had merit, and all was well and we did not watch her as close. Now that stretched our awareness lapse out to 1 maybe 2 minutes. Finally some free time!
When you are parents you have to give up your own world, and make sure someone else's world is safe.

Has anyone ever answered this question differently from the responses here? cant imagine who could sounds like plain common sense to me...in the state of florida you cannot sell a house with a swimming pool without providing a saftey fence approved by a home inspector and its a shame you have to have laws like that to protect children from irresponsible parenting

Also, I don't know that we've heard "one side", as it seems from the OP that the story came from an attorney that wasn't even involved in the case, so it's more of a third party narrative than a closing argument.

What a bunch of crap . They couldn’t figure out that their kid could fit through the door. If there are any lawsuits it should be against them for criminally negligent manslaughter. Enough...enough...and enough with always blaming someone else for our mistakes. This is the worst and a horrible tragedy and that is where it should end. What should the label have said "if you are too stupid to figure it out on your own...please be aware that little people can also go thru this opening!"

While juries will hear evidence they will rarely if ever hear all of the evidence, only what gets admitted. Big difference. So in a way people's opinions here are no different than that of the jury that might hear this case. You just have to understand that the opinions are based on the "evidence" that is presented in these posts, not on a week or two of testimony. I think people anywhere are entitled to an opinion on the matter without having sat in the jury box.

Don't take offense, but I think he was asking how a court would find in that case, so I addressed this issue and have been doing that all along. In my own opinion, the parents are the idiots.

POWER PET, World's Largest Selling Fully Automatic Electronic Pet Doors

These doors have been around in some form or another for awhile now. For 300 dollars, it would've saved the child. Very sad story.

I agree, it seems like common sense. On the other forum where I took this from one poster stated that in his experience the majority of juries would find in favor of the parents. He stated that this was because the folks on the jury would think that this one little case isn't going to hurt the big ol manufacturing company.

It really makes me wonder sometimes. Just like having a fence around the pool.....I understand that it is practical and good judgement, but there is no way that you (the pool owner) should be liable if someone (who is uninvited) gets hurt in your pool. It is just like someone stepping in a hole in your front yard and breaking a leg while leaving your house after breaking in. Can they sue you? Yes. Will they win? 50/50
