I'm siding with the door company on this one if the people were not conscious enough to either put a locked gate around the pull or a small fence around the patio then they are 100% at fault. they would only sue as a way to lay blame on someone else so as not to feel so guilty themselves.

Door manufacturer not at fault.

There is no warning label on my toilet lid warning to keep it down so a small child doesn't some how crawl in and drown.

There is no warning label on our nick-knack shelf advising that small objects could choke a child if they grabbed it and put it in their mouth....

There is no warning label on..... and so you get the point.

You must use good adult judgment as your "warning labels" and not blame others for not doing your thinking for you in every aspect of life.

Well, since we're missing a HUGE part of the story, we don't have much choice. In order to hear a case, a jury must hear both sides presented with evidence. We've heard part of one side with no evidence. So here we go, we make up our own evidence and state our opinion based upon said evidence. Have you ever been to court for a Trial by a Jury of your Peers?

What part of the story is missing? Careless parents allowed their child to tragically drown. I know where my 2-year old is and what she's doing at all times. Period. There is no choice in the matter when you have infants. Well, there is...and here we see the devastating results.

Jury of your Peers? Good luck with that...maybe your peers, not mine.

I don't know exactly what part of the story we're missing. If I knew what part we were missing, we wouldn't be missing it, would we????

So as for ever seeing a trial, I'll take that as a no. Are you a lawyer? Sound a lot like you think you are, but really are not.

actually everyone i know who owns a pool has a small fence around it with a deadbolt so that children cannot access the pool without their knowing about it. Its pretty common here a couple of the pool companies and fence companies put together special packages with discounts on both the pool and fencing.

A 9 month old should NEVER be out of their parent's sight. My 2 yr. old never leaves mine. The blame is all on the parents.

Actually, most pools around here have a separate fence, above and beyond any fence around the yard. I don't have a pool, so I'm not sure, but I believe it's a code-requirement.
