Are my pre-ban HI-CAP Beretta 92/M9 mags CA LEGAL in my XD?
I've owned several high cap 15 and 17 rd mags for my Beretta 92/M9 since before 1994 when they banned them here in California...
They are legal for me to still use in my beretta etc. Well I own a XD-40 that these mags will fit in after *slight* modification to the mag and they still work fine in my baretta as well. The way I read the law that as long as they still work in my Beretta then they are still legal. Im not manufacturering or causing manufacturer a high-cap magazine as it is already a hi-cap magazine and im not increasing capacity..it actually holds a couple less .40 rounds.. My XD-40 is my CCW carry gun and I would like to use these hi-cap mags in it as I could have 15 rds instead of 10, and have a 15 rd backup mag (could only carry one spare mag instead of two also).. I know this is *Iffy* in the law..but I want to nail down is it legal or not. It cant be in between... and I believe it is legal. Anyone have some insight on these |

Back before the band ended, alot of us modified Berreta and Ruger mags to use in our XD's.

You may possess them, I wouldn't carry more than 10 in the mag...Otherwise you are not in compliance...I may be wrong...
You can't transfer them, or when you sell the beretta, you can't sell them...you have to throw them away....ugh..silly law.

Well I am in Kern County...
The highest CCW issueing county in CA. I think Kern issues like more alone than the rest of the state combined.. I work at the largest gun store in our city and our CCW class is packed twice a week of 20 people.. They issue a CCW to pretty much anyone who no criminal background here.. |

My grandfather was a deputy, then DA investigator in Kern back in the 60's and 70's. I guess that has some affect on why I am a deputy now. Here is the deal (as I understand it): If you have one "high cap" magazine, and you modify it to be used in a different gun, you have not created a new magazine. There are no more hi cap magazines in California than there were prior to your modification. As long as it is possible that your legally posessed the hi capacity magazine in California prior to the ban, you are good. For instance, you could not have legally posessed a hi cap XD magazine prior to the ban because they did not exist! If you do choose to modify a magazine in such a manner, feel free to load it all the way up. There is no law concerning how many rounds you carry, just what magazine they are in. This is how we interpret it a couple counties north of you, but you might ask some of your local gendarme to make sure. Good luck to you!
