Carrying laws for Florida

Carrying laws for Florida

Hey Guys & Ladies,

Question I live in Florida and was wondering what all places can I carry in to and not to carry to. I know I can take my gun in to a restaurant, hotels and few other places...I know in restaurants I can take the gun with me as long their not selling beer, liquor or any of that nature. I know make sure I have my concealed weapons permit with me at all times when carrying.

I asked this question before to a local gun shop some say I can wear my handgun outside of my belt in the holster as long I don't take it out and show it off to anyone which I do NOT have intention on doing that. Some of the others replied leave it hidden so no one will cause a problem with you or etc. I've seen a different gun shops that some of the employees where the gun in its holster on the outside of their jeans that's why I am asking this question.

I know it takes common sense on what to do and not what to do and mostly use my brain which I am pretty smart on using my brain first.

Im not familiar with Fla laws but there are some standards

Dont take it into any post offices, court houses, schools or on any Govt property

Go to your local court house and ask them if you can have a copy of the state gun laws

1) Florida clearly defines the "prohibited places" in the state statutes. Anywhere not prohibited you are allowed to carry. A "No Firearms" sign by a private business is not supported by the law. You can carry, but must leave if noticed/asked to leave. If you don't, you are felony tresspassing. Federal Gov't property (VA, Courts, Fed Offices/Buildings, Post Office, Bases, ect) are always off-limits regardless of state laws.

I suggest you read the statutes. You can carry in a resturant with a bar as long as you are not sitting in the designated area of the bar. You cannot carry in an establishment whose primary function is as a bar.

2) Florida does not allow open carry in public unless you are directly traveling to (no stops between home and destination)/actively fishing/camping/hunting/gun range. Again, check the statutes.

You can open carry on private property. The gun store owners/employees can open carry at the store since it is private property and the owner allows employees to. You can carry with an OWB holster in public, but the gun must remain concealed under clothing.

You NEED to read the statutes. Not understanding them can land you in big trouble. The Florida Concealed Carry forum is a good resource for FL specific laws and regs.

Also pick up a copy of the most current edition of Jon Gutmacher's book, "Florida Firearms: Law, Use & Ownership."

The author is a Florida lawyer who practices in the area of gun ownership and concealed carry and he updates the information regularly as the statutes tend to change periodically.

You may also find it at your LGS.

It was recommended by my CCP class instructor in addition to Chapter 790, Florida Stautes.

Drawing your gun for ANY reason other than to put it away may be construed as menacing, pointing, or (in SC) use of deadly force. You don't even have to fire a shot. Does FL have an open carry law? If so, no one should bother you. IMO - open carry is a deterrent, it may prevent something from happening. Concealed carry is a response to something that's already gone down. You're immediately behind the curve. However, beware of the knee-jerk reactions from the Zimmerman case.

Employees on duty and individuals on their own private property are a different situation. Given the boss's permission, employees may carry openly in the course of their job. Gun shops are a prime target for robberies, but the BG thinks twice when he walks in and sees 5 or more large caliber guns on the employees waists. In that case, their job is to prevent by intimidation, not respond. Most states will allow you to carry openly on your own property. At my first visit to Shooters Express in Belmont NC, I asked an employee if it was ok to carry my concealed weapon in. He laughed and said, "Sure. If something happens, the more guns we have pointed at the BG, the better it is!"

· Any place of nuisance as defined in s. 823.05 · any police, sheriff, or highway patrol station; · any detention facility, prison, or jail; · any courthouse; any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom; · any polling place; · any meeting of the governing body of a county, public school district, municipality, or special district; · any meeting of the Legislature or a committee thereof; · any school, college, or professional athletic event not related to firearms; · any school administration building; · any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose; · any elementary or secondary school facility; · any area vocational-technical center; · any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or non-lethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile; · inside the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported
