Here's a story from today's Des Moines Register that illustrate Iowa's need for a "stand your ground" law. There is a bill in the legislature now, hopefully it passes.

Man that is some BS....the DA just by listening to the tape should of dropped the charges.....man lost everything and it seems that the APT complex was able to see what he had and that's why they didn't "contact"...also he should be able to sue them cause they made him guilty before proven innocent.....but cause of his lack of funds he probably won't ...unless he gets a Lawyer to approach him PRO BONO....

As a former resident of WDM, I can't disagree with the race issue either. I've lived all over the US, and never lived in a more bigoted town. Oh, yeah, and I'm white.

The apartment owners, the Des Moines police dept and the Des Moines DA should all be sued along with the two guys that attacked him!

Wow, this is really a bad case of injustice.

However I think it is a good reminder if you carry to do ALL YOU CAN to avoid having to draw and fire. Not saying he did anything wrong, but even though he was found legally in the right in the end, Mr. Lewis lost a lot in the process.
I read about many other cases of road rage or other confrontations that went from bad to worse when someone might just as well have disengaged from the confrontation and cooled off before the shooting started.
Hope things turn around for the victim here (Mr. Lewis).

Part of me wants to agree with you and a larger part says that is what is wrong with our society, to many are walking away and letting this crap continue. The police don't or can't do squat and the courts and lawyers protect the bad guys. The saying What you allow, you encourage has never been more true!

This is too bad, and I do pray for this man that his life gets back on track. He was in fear of his life. No one in the court was there, or feeling HIS fear. Its stupid that people who aren't there can put a legal twist on someone elses fear. He warned them, and they still charged. What would the cops have done in that situation, if someone was trying to punch out their cruisers windows, then after they pulled their weapon, the scum bag charged? They would have dropped them too. But, it would have been ok, cause the stupid cops have a badge. Makes me sick.

Not saying it's right, I totally agree with you that this whole story sucks the way it played out. And the fact that so often nowadays, it would play out just like this again in many other states. I just thought it was a good reminder to remember no matter how we THINK the system should work, this is the way it REALLY works and we are all much better off avoiding a shooting situation if possible. Not saying it's always possible, and definitely not saying Mr. Lewis did the wrong thing. But if we have to draw and shoot, there may be heavy consequences even if we are justified and cleared of any alleged wrongdoing. Members of this forum are still dealing with the consequences of shootings that were justified. That's really my point, that we really need to be thinking ALOT when we carry.
