.40s go so fast and generate so much heat they actually cauterize the hole when the pass through.

If you are chasing him you won't be in any position to claim self-defense. Shoot at someone even with the intent to shoot out a tire and I think you are guilty of using deadly force with the intent to kill.

that would be a good rationale... but what if he shot at me first then I would have to defend my self...

Uh...you're chasing them. If the start shooting at you, STOP CHASING THEM.

I really can't think of any situation where shooting the tires would make sense, either tactically or legally.

Well, first of all, I'm not shooting at someone while in a moving car (either me or my target). Maybe if it's very slow moving, otherwise they'll be out of the area soon enough.

But more importantly, assuming you can even hit the tire, what's stopping that 4000 pound car from careening out of control and hitting a school bus or something?

Either way, it's a losing situation. It's also a situation you'll never find me in.
